LMIA Categories
There are two primary LMIA categories:

2. International Mobility Program (IMP)
The IMP is designed for foreign workers who are exempt from the LMIA process due to international agreements, reciprocal agreements, or specific categories like intra-company transferees.
LMIA Process
Step 1: Employer Application
The employer initiates the LMIA process by submitting an application to ESDC. This application includes details about the job, the company, recruitment efforts, and a commitment to certain conditions, such as providing safe and suitable working conditions for the foreign worker.
Step 2: Job Advertisement
In most cases, employers are required to advertise the job position on various platforms, including the Canadian Job Bank, for at least four weeks. This step is aimed at proving that no Canadian citizen or permanent resident is readily available for the position.
Step 3: Assessment and Decision
ESDC assesses the LMIA application and evaluates the employer’s efforts to hire a Canadian worker. The decision is based on factors such as wage, working conditions, and the potential impact on the local labor market.
Step 4: Positive or Negative LMIA
If the LMIA is approved, it is considered a “positive” LMIA, and the employer can proceed with hiring the foreign worker. If it is denied, it is a “negative” LMIA, and the employer cannot hire a foreign worker for that position.
