IRCC released detailed requirements for the temporary public policy to lift the working hours of study permit holders

On November 22, 2022, Canada published the requirements for the temporary public policy to lift the work limitation of study permit holders. Previously, eligible international students could work without a work permit no more than 20 hours per week off-campus during regular academic sessions.

The temporary change came into effect on November 15, 2022, and will expire on December 31, 2023.

The new policy is intended to reduce the labour shortages that the Canadian employers are currently facing. Besides, it will also help international students to gain valuable work experience in Canada.

Eligibility Requirements

Delegated officers may grant an exemption from the requirements of the Regulations, if a foreign national:

  • is a holder of a valid study permit;
  • is a full-time student enrolled in at least 6-month post-secondary academic, vocational or professional training program, or a vocational training program at the secondary school level offered in Quebec at a designated learning institution; the program should lead to a degree, diploma or certificate.

or

  • Previously held a study permit;
  • Is awaiting a decision on the application described in (2);
  • Is authorized to study without a study permit pursuant to section 189 of the Regulations;
  • Is a full-time student enrolled at a designated learning institution as defined in section 211.1 of the Regulations; and
  • Is enrolled in at least 6-month post-secondary academic, vocational or professional training program, or a vocational training program at the secondary school level offered in Quebec which leads to a degree, diploma or certificate.

Please note that to be eligible for this public policy, the foreign national’s study permit application (including study permit renewal application) must have been received by IRCC on or before October 7, 2022.
