Canadian immigration Releases An Update Condition Or Restriction of Approval For Employer Job Offer Stream

December 8, 2021 – the Ontario Immigrant Nominee Program updated its standard conditions and restrictions with regards to applicants’ approvals for certificates of nomination as well s employment positions under the Employer Job Offer Streams. It was mentioned that all nominees, as well as employers, must act in accordance with all the conditions. If they fail to do so, it may result in the cancellation of their approval.

 

Listed below are the conditions that nominees must follow if they receive a nomination under the Employer Job Offer Stream:

1. You must continue to demonstrate a reasonable basis as an intention to live in Ontario province
2. If you are already working for an employer, you must be employed in one of the approved employment positions as of the date of your nomination.
3. If you are not already working for the employer, you must apply for a work permit within six months and must start working in any of the approved employment positions within ten months from the date you have been nominated.
4. If you have not yet started working in any of the approved employment positions within the span of 10 months, you must inform the OINP immediately in the form of writing
5. During your nomination period, you must continue to be employed in any of the approved employment positions. Meaning, your employment term must be consistent all throughout the nomination period, this includes the following
• Position title and work duties
• Employer
• Salary
• Hours of work
• Work location

6. In the circumstance where there are changes in the nature of your employment that the above-mentioned term was included, you must notify the OINP immediately in the form of writing. You may do so by contacting them through ontarionominee@ontario.ca

Note that it was mentioned that you must strictly follow the conditions or else your nomination will be canceled. Below are the circumstances on how your nomination could be canceled:

• Failure to meet the above-mentioned conditions
• Job offer was withdrawn by the employer
• You decline your job offer
• Termination of employment either by you or your employer

Meanwhile, if you are an employer who is approved for an employment position under the Employer Job Offer stream, here are the conditions you must follow:

1. If the nominee is already working for you, you must employ him/her in the approved employment position as of the date of nomination
2. If the nominee is yet to work with you, you must employ the nominee in any of the approved employment positions within ten months as of the date of nomination
3. If the nominee has not yet started working in any of the approved employment positions within the span of ten months from the date of nomination, you must inform the OINP immediately in the form of writing
4. During the nomination period, you must continue to employ the nominee in the approved employment position, and this includes the following:
• Position title and work duties
• Salary
• Hours of work
• Work location

5. In the circumstance where you can no longer comply with any of the conditions stated above, immediately notify the OINP in the form of writing and contacting them through ontarionominee@ontario.ca

 

The approval of the employment position, as well as the nomination, maybe canceled if:

• Failure to meet the above-mentioned conditions
• Job offer was withdrawn by the employer
• You decline your job offer
• Termination of employment either by you or your employer
