How Does A TRP Help A Foreign Traveler To Enter Canada?
Planning a trip to Canada? You need to have a Temporary Resident Permit (TRP) to do so. If you have been charged with a criminal offense such as driving under the influence, assault, or theft, this can be an issue and you can be considered inadmissible to Canada.
However, there is a solution to this problem. If a person having criminal inadmissibility wishes to enter Canada, this is where the Temporary Resident Permit (TRP) enters as this is issued as a temporary solution to enter the country. The purpose of a Temporary Resident Permit is to allow a traveler to enter Canada for a notable reason; may it be as a worker, student, or family reason. In connection to this, note that tourism as a reason is not accepted by Canadian immigration.
For a traveler to be able to apply for a TRP, one must submit an application providing an explanation of their criminal history along with a strong reason why they are deserving to come to Canada. An applicant must also include documents to support their application; documents such as proof of the reason for entering Canada, background check, and other court documents.
There are two ways on how to apply for a TRP; one is via Port of Entry (POE) – whether by sea, land, or air; and the other is via Canadian consulate. However, POE is only available for use if you are an American citizen or a permanent resident in the U.S. If you are a non-American, you will have to apply through a Canadian consulate for your Temporary Resident Permit (TRP) application to be processed. An application for a TRV costs $200 CAD no matter which way an applicant applies.
Application for a TRP through a Canadian consulate may take time as the processing takes 3 – 6 months. Having an experienced immigration officer who is knowledgeable about the many reasons why a candidate’s visit can be justified is considered to be the best approach, especially for foreign nationals.
Meanwhile, applying via Canadian POE that includes land crossings, sea entry points as well as airports gives an advantage as it is immediate processing. Through POE, a Canadian immigration officer will consider and process the application right on the spot and be able to decide if an applicant may receive a TRP in minutes. However, given the advantage of applying through TRP, there is also a disadvantage, which is unpredictability. Why? Because an applicant won’t know if their application will be approved or denied by the Canadian immigration officer who will review their application, not until the day the applicant will try to enter Canada.
Applying for a TRP may be hard and applications are often difficult to understand as a case can be for the applicant or can be both for the officer who reviews the application and the applicant. In some cases, an application has the potential to be accepted but then it was denied due to a lack of evidence and explanation. The purpose of a TRP application is for an applicant to justify and argue on why they need to be accepted and enter Canada; that’s why in some cases, an experienced lawyer can be of help although it is not required.
